Privacy policy [argo®box ]

Hereinafter we inform you about the collection of personal data when using [argo®box]. [argo®box] is a software developed by argo.cloud.solutions GmbH for CBRE GmbH. The software is used to provide real estate listings.  Personal data means all data that can be related to you personally, e.g. name, address, email addresses, user behaviour. [argo®box] has extensive technical and organizational safeguards in place to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. These security procedures are regularly reviewed and adapted to technological progress.

3. Notes on [argo®box]

[argo®box] uses cookies and other tracking methods to simplify the use of the application as well as to validate optimisation approaches for [argo®box]. 

Cookies are used in accordance with the requirements of the EU-GDPR. 

Within the scope of service and software provision, argo.cloud.solutions GmbH exclusively stores personal data of end users on behalf of CBRE GmbH. A transfer of personal data by argo.cloud.solutions GmbH to third parties is generally excluded.

4. Your Rights

You have the following rights in relation to personal data relating to you:

4.1 General Rights

You have a right of access, rectification, erasure, restriction of processing, objection to processing and data portability. Insofar as processing is based on your consent, you have the right to revoke this with effect for the future.

4.2 Rights relating to Data Processing based on Legitimate Interest

Pursuant to Art. 21 para. 1 GDPR, you have the right to object at any time to the processing of personal data relating to you on the basis of Art. 6 para. 1 lit. e GDPR (data processing in the public interest) or on the basis of Art. 6 para. 1  lit. f GDPR (data processing for the protection of a legitimate interest) for reasons arising from your particular situation; this also applies to profiling based on this provision. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

4.3 Rights relating to Direct Marketing

If we process your personal data for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing in accordance with Art. 21 para. 2 of the General Data Protection Act (GDPR); this also applies to profiling, insofar as it is associated with such direct marketing.

If you object to processing for the purpose of direct marketing, we will no longer process your personal data for these purposes.

4.4 Right to Lodge a Complaint with a Supervisory Authority

You also have the right to lodge a complaint with a competent data protection supervisory authority about our processing of your personal data.

5 Collection of Personal Data when Visiting our [argo®box] Website

When you visit [argo®box], your log data are collected in addition to cookies (see Section 7). These log data are movement data of the end user and serve the purpose of optimising [argo®box] and can be viewed by CBRE GmbH. Based on these log data, the following is recorded: 

Initial login of the end user including confirmations (GTC, privacy policy)
Subsequent login of the end user
Access of the end user to the online listing of a property
Property status change by the end user
Contact invitation by the end user ("sharing")
Document download by the end user
Messages (callback request, viewing request, general contact)
Notes on the properties

We delete the personal data collected in this context as soon as the end user requests the erasure of their data or the storage is no longer necessary. 

6 Contact us via [argo®box]

When you contact us via [argo®box], the data you provide (e.g. your email address, your name and, if applicable, your telephone number) will be stored by us in order to answer your questions. This information is used to specify your request and to improve the processing of your request. This information is communicated for the fulfilment of the contract (see GTCs), Art. 6 para. 1 lit. b GDPR. Insofar as this involves information on communication channels (e.g. email address, telephone number), we may also contact you via this communication channel in order to respond to your request. 
On the offer platform [argo®box], it is possible to ask questions about a specific property in the property overview and in the property comparison. You enter the subject and the message and when you send it, the message (including the subject) and details of the property are saved in the so-called forum, which you and the CBRE employees can view at any time. The time of creation, first and last name and the content of the message are saved. The responses of CBRE employees are also stored here as a communication history with details of the first name, surname, time and content of the message. 
You can also click on "Contact" in the menu at any time and send a message to CBRE employees without reference to a specific property. These messages are then also displayed in the forum with communication history and can be viewed by you and CBRE employees at any time.
In addition, you can make notes on properties in the online listings as well as in the property comparison. These notes are visible to CBRE employees as well as anyone with whom you have shared the offer. You can adjust the notes at any time (change or delete content).

We delete the data collected in this context after the storage is no longer required or restrict the processing if there are statutory retention obligations.

7 Use of Cookies:

When you use [argo®box], cookies are stored on your computer. Cookies are small text files that are stored on your hard drive and associated with the browser you are using, and through which certain information flows to whoever sets the cookie. Cookies cannot run programs or transmit viruses to your computer. They serve to make the internet offer as a whole more user-friendly and effective.

We only store and use the cookies listed above on your device to the extent that this is absolutely necessary for the operation and security of our website. We do not use these cookies to create profiles of you for advertising or market research purposes.

7.1 Transient Cookies 

These cookies are automatically deleted when you close the browser. These particularly include session cookies. These store a so-called session ID, with which various requests from your browser can be assigned to the joint session. This allows your computer to be recognised when you return to our website. The session cookies are deleted when you log out or close the browser.

8 Data Transmission

Your data will not generally be transferred to third parties unless we are legally obliged to do so, or the transfer of data is necessary for the performance of the contractual relationship, or you have previously expressly consented to the transfer of your data. 

External service providers and partner companies only receive your data insofar as this is necessary to process your enquiry. In these cases, however, the scope of the transmitted data is limited to the necessary minimum. Insofar as our service providers come into contact with your personal data, we ensure within the framework of data processing pursuant to Art. 28 GDPR that they comply with the provisions of the data protection laws in the same way. 

We make a point of processing your data within the EU / EEA. However, we may use service providers who process data outside the EU / EEA. In these cases, we ensure that an adequate level of data protection is established with the recipient before transferring your personal data. This means that via EU standard contractual clauses or an adequacy decision, a level of data protection is achieved that is comparable to the standards within the EU.
